FSSAI License for Confectionery and Chocolate Business in India 2026
Guide to FSSAI licensing for confectionery manufacturers, chocolatiers, candy makers, and dessert businesses in India. Standards, labelling, and compliance requirements.
Confectionery and Chocolate: FSSAI License Requirements
India's confectionery and chocolate market is growing at 8% annually, driven by increasing disposable income, gifting culture, and premium chocolate consumption. If you are making or selling chocolates, candies, toffees, or other confectionery, you need the correct FSSAI compliance in place.
Who Needs What FSSAI Category?
| Business Type | FSSAI Category |
|---|---|
| Home chocolatier (annual turnover ≤₹1.5 crore) | Basic Registration |
| Small commercial chocolate/candy manufacturer | State License |
| Large confectionery manufacturer with pan-India distribution | Central License |
| Confectionery retailer (selling third-party brands) | Basic Registration |
| Chocolate café or dessert shop | Basic Registration or State License |
FSSAI Standards for Chocolate
FSSAI has specific compositional standards for different types of chocolate under the FSS (Food Products Standards and Food Additives) Regulations, 2011:
- Dark Chocolate (Plain Chocolate): Minimum 35% total cocoa solids, of which at least 18% is cocoa butter and 14% is non-fat cocoa solids
- Milk Chocolate: Minimum 25% total cocoa solids + minimum 12% milk solids + minimum 2.5% non-fat milk solids
- White Chocolate: Minimum 20% cocoa butter + minimum 14% milk solids + maximum 55% sugar
- "Chocolate Flavoured" products: Less than the minimum cocoa content — must be labeled as "chocolate flavoured" not "chocolate"
Permitted Additives in Confectionery
Only FSSAI-approved additives may be used in confectionery. Common permitted additives include:
- Emulsifiers: Lecithin (INS 322), Polyglycerol polyricinoleate (INS 476) — used in chocolate
- Stabilisers: Carrageenan, Xanthan gum
- Colours: Only permitted food colours — e.g., Sunset Yellow (INS 110), Tartrazine (INS 102), Carmoisine (INS 122)
- Flavours: Natural and synthetic flavours (must be declared on label)
- Preservatives: Limited use — benzoic acid, sorbic acid permitted in some confectionery types
Note: Chocolate products cannot use artificial colours — natural or specific permitted colours only.
Labelling Requirements for Packaged Chocolates and Sweets
- Product name (use FSSAI-defined name — e.g., "Milk Chocolate" if it meets the standard)
- FSSAI license number
- Ingredient list with all flavouring substances and food colours declared by INS number and common name
- Allergen declaration: nuts, milk, soy, wheat — extremely important for chocolate
- "May contain traces of [nut/milk/etc.]" warning if manufactured in shared facility
- Best Before date (chocolates typically 6–24 months)
- Storage instructions ("Store in a cool, dry place, away from direct sunlight")
- Net weight
- MRP
- Batch number
Special Considerations for Gifting and Festive Chocolates
The gifting segment is a major revenue opportunity for chocolatiers, especially during Diwali, Christmas, and Valentine's Day. Key points:
- Gift boxes with assorted chocolates must carry FSSAI number and best before date on the outer box
- Individual pieces inside a gift box — if not individually wrapped with labels, the outer box label must cover all regulatory requirements
- Custom/branded chocolates made for corporate gifting still require the manufacturer's FSSAI number on the packaging
- Imported chocolates re-gifted or sold by a retailer must carry an Indian sticker label with the importer's FSSAI number
Common FSSAI Violations in Confectionery
- Using banned colours (Metanil Yellow, Rhodamine B) in coloured sweets and candies
- Labelling a product as "Dark Chocolate" when cocoa content is below FSSAI minimum
- Failing to declare nut allergens — a serious safety issue, especially for children
- Using non-permitted vegetable fats in place of cocoa butter without declaring it as "chocolate substitute"
- Selling loose confectionery past their Best Before date
